CCI Moves SC to Expedite Amazon, Flipkart Cases

Competition Commission of India (CCI) has filed a transfer petition with Supreme Court seeking transfer to the apex court from various High Courts of as many as 23 legal challenges to its 2019 investigation of Amazon and Flipkart.

In its petition, the competition watchdog has alleged that various sellers of platforms Amazon and Flipkart had mounted legal challenges before various High Courts to scuttle the CCI probe.

In August, the CCI’s investigation unit had reportedly  concluded that Amazon and Flipkart had breached India’s anti trust laws by favouring select sellers on their platforms. The investigation unit had also reportedly concluded that Samsung and Vivo had indulged in anti-competitive conduct by colluding with two e-commerce companies and exclusively launched products online. 

Post these findings, nearly two dozen cases were filed by vendors of Amazon and Flipkart in five High Courts to debilitate and scuttle the entire investigation process. The vendors who filed the lawsuits alleged that CCI had not followed due process in its investigation.
